El acceso y uso del sitio web y de la aplicación «VisualGym» (en adelante, «la App») atribuye la condición de usuario e implica la aceptación plena de las presentes condiciones. Si no está de acuerdo, deberá abstenerse de utilizar el sitio web o la App.
Los contenidos del sitio web y de la App (textos, imágenes, logotipos, iconos y demás materiales) son propiedad de VisualGym. Queda prohibida su reproducción, distribución o transformación sin autorización expresa. Las fotos que sube el usuario siguen siendo de su propiedad; el usuario concede a VisualGym una licencia limitada para almacenarlas y procesarlas con el único fin de prestar el servicio.
El usuario se compromete a usar el sitio web y la App conforme a la ley y la buena fe, y a no realizar actividades ilícitas: lenguaje ofensivo o difamatorio, acceso no autorizado o suplantación de identidad, distribución de contenido ilegal, introducción de virus o malware, o uso comercial no autorizado y envío de spam.
VisualGym no se responsabiliza de errores u omisiones en los contenidos ni de los daños derivados de la interrupción, suspensión o mal funcionamiento por causas ajenas a su control (fallos técnicos, cortes de internet o fuerza mayor). En ningún caso será responsable de daños directos, indirectos, incidentales o consecuentes.
Para funcionar, VisualGym trata: tu correo electrónico y datos de perfil (sexo, edad, altura, peso, objetivo, nivel y días por semana); tus gimnasios y máquinas; tus entrenamientos, series y pesos; y tus fotos (de máquinas y, opcionalmente, de progreso corporal). Estos datos se usan únicamente para gestionar tu cuenta, generar y registrar tus entrenamientos y mostrar tu progreso. La base legal es la ejecución del servicio que solicitas y, para las fotos corporales, tu consentimiento explícito.
Los datos y las fotos se almacenan de forma segura en Firebase (Google Cloud), en infraestructura de la Unión Europea, asociados a tu cuenta y accesibles solo por ti. Empleamos a Google (Firebase: autenticación, base de datos y almacenamiento) como encargado del tratamiento.
Las fotos de máquinas y, si decides subirla, la foto corporal se envían a nuestro proveedor de IA (OpenAI) con la única finalidad de reconocer la máquina o generar una valoración orientativa y elaborar tu plan de entrenamiento. La valoración corporal es orientativa y no constituye consejo médico. Las imágenes se procesan para darte el servicio y no se utilizan para crear perfiles publicitarios.
Las fotos de progreso corporal y los datos relacionados con tu forma física son opcionales y se tratan únicamente con tu consentimiento explícito. Puedes no proporcionarlos y seguir usando la App. Puedes eliminarlos en cualquier momento desde la aplicación.
Conservamos tus datos mientras mantengas tu cuenta. Puedes ejercer tus derechos de acceso, rectificación, supresión, oposición y portabilidad editando o borrando tus gimnasios, máquinas, entrenamientos y fotos desde la propia App, eliminando tu cuenta, o escribiendo a info@visualgym.es.
El sitio web y la App utilizan un almacenamiento técnico mínimo (por ejemplo, para recordar tus preferencias y mantener tu sesión iniciada). No utilizamos cookies de publicidad ni de seguimiento de terceros.
VisualGym se reserva el derecho de modificar esta política en cualquier momento para adecuarla a la legislación o a los servicios ofrecidos. Las actualizaciones se publicarán en esta página y entrarán en vigor desde su publicación.
Esta política se rige por la legislación española. Cualquier controversia se someterá a los juzgados y tribunales competentes en España.

Accessing and using the website and the "VisualGym" application (the "App") grants you the status of user and implies full acceptance of these terms. If you do not agree, you must refrain from using the website or the App.
The contents of the website and the App (text, images, logos, icons and other materials) are the property of VisualGym and may not be reproduced, distributed or modified without express authorization. Photos you upload remain yours; you grant VisualGym a limited license to store and process them solely to provide the service.
You agree to use the website and the App lawfully and in good faith, and not to engage in illegal activities: offensive or defamatory language, unauthorized access or identity theft, distribution of illegal content, introduction of viruses or malware, or unauthorized commercial use and spam.
VisualGym is not responsible for errors or omissions in the content, nor for damages arising from interruption, suspension or malfunction due to causes beyond its control (technical failures, internet outages or force majeure). Under no circumstances will it be liable for direct, indirect, incidental or consequential damages.
To work, VisualGym processes: your email and profile data (sex, age, height, weight, goal, level and days per week); your gyms and machines; your workouts, sets and weights; and your photos (of machines and, optionally, body-progress photos). This data is used solely to manage your account, generate and log your workouts, and show your progress. The legal basis is performance of the service you request and, for body photos, your explicit consent.
Data and photos are stored securely in Firebase (Google Cloud), on EU infrastructure, tied to your account and accessible only by you. We use Google (Firebase: authentication, database and storage) as a data processor.
Machine photos and, if you choose to upload it, your body photo are sent to our AI provider (OpenAI) for the sole purpose of recognizing the machine or producing an orientative assessment and building your training plan. The body assessment is orientative and is not medical advice. Images are processed to deliver the service and are not used to build advertising profiles.
Body-progress photos and fitness-related data are optional and processed only with your explicit consent. You can choose not to provide them and still use the App, and you can delete them at any time from within the App.
We keep your data while your account exists. You can exercise your rights of access, rectification, erasure, objection and portability by editing or deleting your gyms, machines, workouts and photos within the App, by deleting your account, or by writing to info@visualgym.es.
The website and the App use minimal technical storage (for example, to remember your preferences and keep you signed in). We do not use advertising or third-party tracking cookies.
VisualGym reserves the right to modify this policy at any time to align it with the law or the services offered. Updates will be published on this page and take effect upon publication.
This policy is governed by Spanish law. Any dispute shall be submitted to the competent courts in Spain.
